Terms of Service

1) Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2) Eligibility

The Service is intended for individuals aged 16+ (or the age of digital consent in your region). By using the Service, you represent that you meet this requirement.

3) Accounts & Local Mode

Aureus supports a local-only mode (no account required) for on-device training logs and features. Certain features—such as cloud backup/sync, cross-device access, or premium content—may require you to create an account and/or hold an active subscription.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate information and promptly update any changes.

4) Subscriptions, Trials & Billing

Access to certain features may require a paid subscription. If you purchase through the Apple App Store, Google Play, or a payment provider (e.g., Stripe, if introduced), billing is handled by that platform and their terms apply. Subscriptions typically renew automatically until cancelled. You can manage or cancel your subscription via the platform’s account settings. We do not issue refunds beyond what the platform provides unless required by law.

We may offer free trials or promotional periods. If you do not cancel before the trial ends, the subscription may convert to a paid plan automatically, subject to the renewal terms shown at purchase.

5) Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or deceptive purposes.
• Reverse engineer, decompile, or attempt to access source code or non-public systems.
• Interfere with security or integrity of the Service or others’ use of it.
• Upload or share content that is illegal, infringing, abusive, hateful, or violates others’ rights.

6) Your Content

You retain ownership of content you create or upload (e.g., workouts, notes, photos). You grant us a limited, non-exclusive, royalty-free license to store and process that content solely to operate and improve the Service (e.g., syncing your data, generating insights, or troubleshooting issues).

You are responsible for ensuring you have rights to the content you upload and that it complies with these Terms and applicable law.

7) Our Intellectual Property

The Service, including its design, features, software, text, images, trademarks, and other materials, is owned by or licensed to Aureus Fitness and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8) AI Features & No Medical Advice

The Service may provide training suggestions or insights powered by algorithms or AI. These are for informational and educational purposes only and are not medical, nutritional, or professional advice. You are responsible for your training decisions. Consult qualified professionals before making significant changes to your training, diet, or lifestyle.

9) Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10) Limitation of Liability

To the maximum extent permitted by law, Aureus Fitness and its affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, or goodwill, arising from or relating to your use of the Service. Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid to us for the Service in the 12 months preceding the claim, or (b) AUD $50.

11) Indemnity

You agree to indemnify and hold harmless Aureus Fitness and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

12) Termination & Suspension

We may suspend or terminate access to the Service at any time if we reasonably believe you have breached these Terms, engaged in fraud or abuse, or if required by law. You may stop using the Service at any time, and you can delete your account (if applicable) following the instructions in the app or by contacting us.

13) Governing Law & Venue

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia, for any dispute arising out of or relating to these Terms or the Service.

14) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date below. If a change materially affects your rights, we may provide an in-app notice. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
